A fine of up to 1 million rubles for the production and turnover of falsified goods may appear in the administrative Code of the Russian Federation

As the first Deputy Chairman of the Federation Council Committee on constitutional legislation and state construction Irina Rukavishnikova told TASS on Thursday, this amount of sanctions was agreed by the working group on the preparation of a new version of the Code of administrative offenses of the Russian Federation.

According to the draft articles, the text of which is available to TASS, for the production and turnover of falsified goods (except for medicines, including for use in veterinary medicine) it is proposed to introduce punishment in the form of a warning or a fine in the amount fr om 3 to 5 thousand rubles for citizens, from 100 thousand to 250 thousand rubles for individual entrepreneurs, with possible additional sanctions such as confiscation of the object of the offence or administrative prohibition of activity for up to 30 days with the confiscation.

For legal entities, it is proposed to establish liability in the form of a fine from 250 thousand to one million rubles with possible additional sanctions in the form of confiscation of the subject of the offense or an administrative ban on activities for up to 30 days with confiscation.

As the Senator explained to TASS, currently the article on falsification concerns only medicines, medical devices and dietary supplements. She stressed that the appearance of the article on responsibility for the production and turnover of falsified goods in the draft of the new administrative code will help to preserve the health of consumers.

‘This article in the draft of the new code, which was prepared by the Ministry of justice, is completely new. The principle of penalties in it can be explained by the fact that human health is the greatest value that each of us has. This was bitterly confirmed by the coronavirus pandemic. And falsified products, such as food, can cause irreparable harm to health,’ Rukavishnikova said.

According to her, it is primarily about food products, ‘especially those intended for consumption in kindergartens, schools, health care institutions, wh ere counterfeit or falsified dairy, meat and other products pose a direct threat to health.’
