A Moscow court has abstrained the claim about bankruptcy of “Ostankino dairy plant”

The ruling of the Moscow arbitration court specifies that the reason for the bankruptcy claim against “Ostankino dairy plant” was a debt of 93.5 million rubles to LLC “Agroinvest”. The dispute about this money happened between the parties six months ago. In October 2019, "Agroinvest" has addressed in court with the statement for the recovery of the aforementioned debt. In December of the same year, the parties concluded a settlement agreement, according to which “Ostankino dairy plant” had to repay the debt in full by July 10, 2020.

However, the terms of the agreement were apparently not met. This was the reason for “Agroinvest” to file a bankruptcy claim against the plant. The arbitration court registered the application of "Agroinvest" at the end of June 2020, and the day before suspended the document due to the lack of a writ of execution. At the same time, the arbitration ruling specifies that the plaintiff can provide the missing documents by August 7 of this year.

We will remind that earlier the Arbitration court of Moscow declared JSC “Ostankino dairy plant” bankrupt. This company, as well as LLC of the same name, is part of the Ukrainian dairy holding Milkiland. JSC “Ostankino dairy plant” was declared bankrupt in August 2017. A bankruptcy procedure has been introduced for the company.

By data of Kartoteka.ru, LLC “Ostankino dairy plant” with an authorized capital of 324.9 million rubles was registered in Moscow in 2017. The company is engaged in the production of milk and dairy products. General Director of the company is Olga Yurkevich, beneficiary – PJSC "Milkiland N.V.", registered in the Netherlands. In 2018, the revenue of “Ostankino dairy plant” amounted to 4.5 billion rubles, net profit - 29.9 million rubles.

LLC “Agroinvest” with the authorized capital of 100 thousand rubles was registered in Moscow in 2017. As the main activity the company indicates wholesale trade in food products. General Director and founder of the company is Viktor Goryachev. In 2018, the revenue of “Agroinvest” was 248.4 million rubles, and its net profit was 3.2 million rubles.
