Creditors of Cheese and butter factory Koshkinsky dispute its lease by a daughter company of Rusagro

JSC Rosselkhozbank, as well as LLC KRC EFKO-Kaskad and JSC Bank DOM.RF applied to the Arbitration court of Samara region. Thus, the first one asks to recognize the lease agreement between Cheese and butter factory Koshkinsky and Molochnye producty Rusagro dated August 27, 2018 as not concluded. Two other plaintiffs are trying to invalidate the lease agreement between the same parties — dated January 1, 2019 - and oblige Molochnye producty Rusagro to pay Koshkinsky the difference between the market value of the rent and the one specified in the contract for the entire period of its validity. The statement is about 22.9 million rubles.

Moreover, as part of the latter claim, a judicial evaluation examination was appointed at the request of the plaintiff. The expert was asked to determine the market value of rent from January 1, 2019 to the present, including monthly, for property leased under the agreement of the Cheese and butter factory Koshkinsky and Molochnye producty Rusagro.

Both applications concerning the dispute over lease agreements are scheduled for consideration on December 2.

In addition, Alexander Shalygin, the bankruptcy Trustee of Koshkinsky, is trying to challenge a number of transactions made by the management of the company as invalid. This includes transactions involving the transfer of 619 million rubles by Koshkinsky in favor of ALEV trading house in the period from May to September 2018. The Manager wants to return this money to Koshkinsky and restore its debt to TH ALEV for the specified amount. Consideration of this claim by Alexander Shalygin is scheduled for the end of November.

We will remind that Cheese and butter factory Koshkinsky, JSC ALEV and TH ALEV were part of the group of companies ALEV, which specialized in the production of dairy products in Ulyanovsk and Samara regions. All of these companies were declared bankrupt in February 2019. At the same time, they initiated the procedure for declaring bankrupt themselves, referring to the presence of debts to creditors in the amount of more than 3 billion rubles for each of the companies.

The largest creditor of Cheese and butter factory Koshkinsky is Molochnye producty Rusagro, which has a debt of 910.5 million rubles. Also among the creditors are JSC UniCredit Bank (750 million rubles), JSC Rosselkhozbank (537.25 million), JSC Bank DOM.RF (296.58 million).
