Dishonest mark: the regional dairy plant "Step’" sent an appeal to the FAS because of the labeling

As it became known to The DairyNews, the Director of LLC “Step’” from Orenburg region Ruslan Sagitov appealed to the Federal Antimonopoly service because of the planned labeling of dairy products. The company is a representative of a small business and by its example tells what the industry will have to face in the regions.

Just to remind, currently, according to the order of the Government, the introduction of DataMatrix codes for the dairy industry begins on June 1, 2020. Since December 1, the turnover of products without labeling is prohibited. The Ministry of industry and trade offers a number of “concessions" - for example, they offer free marks for products valued below 30 rubles (unknown in the mass segment), and postponement - on June 1, 2020, there starts registration of enterprises in the labeling system; on December 1, 2020 there will be introduced a mandatory labeling of products with shelf life more than 1 year; on March 1, 2021 there will be introduce mandatory labeling of products with a shelf life of less than 1 year.

According to Ruslan Sagitov, LLC "Step’" is a dairy plant with a turnover of 140 million rubles a year, producing perishable products. Investments in printers for marking codes will amount to 2.2 million rubles, investments in code readers - 100 thousand rubles, solutions for equipment for rejection of unreadable codes are still unknown - there are no offers on the market.

- The cost of the marking codes for our company will amount to 2-3 million rubles annually. At the same time, we get a 5-10% increase in cost and an increase in bureaucratic processes for all variants of delivery of products with labels", said Ruslan Sagitov.

Now the company has two delivery options:  

We need to know which package of milk will go to which store 

We must specify all codes for the delivered products in the invoice 

If the package leaks on the way, we need to change the invoice

We have 200-300 contractors daily who buy for 500-1500 rubles, 2 storekeepers, 2 loaders, 4 accountants and a whole night to prepare everything for the morning delivery. No one will buy yesterday's milk. (we will need a night accountant, maybe several, night storekeepers and loaders)

The second option:  

We deliver as now, but when delivering a driver takes photo of each package and sends the codes to the accounting department, so that the accounting department prepares invoices and passes them on the next delivery (the delivery will take 2 times longer, we will need 2 times more trucks to have time to deliver products in the morning).

- Who will it occur to falsify local cheap perishable product with a low margin? Does the consumer want to pay for the possibility of checking for falsification local dairy products? - asks Ruslan Sagitov. 

With no obvious benefits from the introduction of labeling, the industry is already getting a significant headache and affects consumers' wallets in regions where demand is already falling.

- After the introduction of labeling, labor productivity will fall, because we will have to have more staff for the same volume of products. Such a role of labeling as increasing tax payments is doubtful - the revenue of companies will fall, - said Ruslan Sagitov.

We remind that according to the industry Union Soyuzmoloko, the system of mandatory labeling is intended only to counteract the turnover of falsified products, the share of falsified products (produced in violation of intellectual property rights, including trademark) in the dairy market is 0.01%. Taking into account the volume of falsified goods on the market, the economic effect of the labeling system will be minimal and not comparable to the cost of its implementation, believe in Soyuzmoloko.

- Labeling in dairy industry creates unequal conditions for products with a short shelf life (e.g. pasteurized milk, which need to deliver daily in small batches) and with a long shelf-life (e.g. UHT milk with a shelf life up to 1 year, which can be delivered every quarter in large batches). Labeling increases the gap between large enterprises and small ones, because labeling, logistics and accounting at large enterprises will increase the cost by a smaller percentage compared to small enterprises, - says Ruslan Sagitov.
