FAS filed a case against Danone on the grounds of cartel collusion in the procurement of milk

The Department of FAS (DFAS) in Kemerovo region filed a case against a subsidiary of Danone registered in Russia — “Danone Russia”, on the grounds of cartel collusion in the procurement of milk, reported in the press service of DFAS in Kemerovo region.
As it was explained in the Department, the reason for the initiation of the case was the statement of the Department of agriculture and processing industry of Kemerovo region on the reduction purchase prices for raw milk since 1 March 2018 by three companies — "Danone Russia" (branch of the dairy plant "Kemerovskiy"), "Dairy plant “Skomoroshka”" and "Transmilk".
"As a result of dealing with the request the specialists revealed the signs of violation of clause 1 part 1 article 11 of the Federal law of 26.07.2006 № 135-FZ "On protection of competition" in the actions of JSC "Danone Russia" (branch dairy plant "Kemerovskiy"), LLC "Dairy plant "Skomoroshka", LLC "Transmilk", — have informed in a press-service of DFAS. This paragraph of the act prohibits cartels.
In Danone and in the Department of agriculture and processing industry of Kemerovo region the request was not responded at the time of publication.
In DFAS in Kemerovo region it was added that in case of recognition these companies guilty of violation of the antimonopoly legislation "regarding legal entities and their officials the cases of an administrative offense will be filed".
In the Department it was explained that making such agreements, recognized in accordance with the antimonopoly legislation as a cartel, "entails an administrative fine on officials in the amount of 40 thousand to 50 thousand rubles or disqualification for a period of 1 year to 3 years; on legal entities - from 0,03 to 0,15 the amount of proceeds of the offender from the sale of goods (works, services), on whose market an administrative offense had been committed, or the amount of expenses of the offender for the purchase of goods (works, services), on whose market an administrative offense had been committed, but not less than 100 thousand rubles".
In DFAS it was added that "it is difficult to speak now about damage which was done to agricultural producers as the first meeting of the Commission of management is appointed only for May 30".
