Ukraine is preparing a third lawsuit to the World Trade Organization (WTO) against Russia regarding restrictions for Ukrainian food products, said Deputy Minister of economic development and trade - trade representative of Ukraine Nataliya Mikolskaya.
"It (the third lawsuit) will affect bans that have been introduced with regard to our food and some industrial products. In fact, because of their failure to comply with technical standards and phytosanitary requirements of the Russian Federation," said Mikolskaya. According to her, the delay in the preparation of this dispute is caused primarily by the fear of Ukrainian companies to take such a step.
She also added that the aim of the new lawsuit, in particular, is to demonstrate to all that the Ukrainian products are really high quality, safe and meet the requirements of the technical regulation and they can be bought.
"Not all Ukrainian and international companies are ready to go in this dispute. We don't judge them. These companies are present on the Russian market with some other products and fear that they will lose the opportunity to sell them. They understand that these are political decisions, so expect some other unpleasant surprises," added Mikolskaya.
Russia since 1 January 2016 imposed a ban on transit road and rail transport from the Ukraine, for which Russia applies rates of import customs duties, distinct from "zero", as well as products included in the "sanctions" list. Since 1 July 2016, according to the decree of the President of the Russian Federation, this ban was extended in respect of these goods from Ukraine, running from Kazakhstan and Kyrgyzstan through the territory of the Russian Federation. After that Kiev has accused Russia of blocking the transit of Ukrainian goods through Russian territory and violation of WTO rules.
In September last year, Kiev has sent to the WTO request for consultations with Russia about the limitations of transit of Ukrainian goods. Later, the trade representative of Ukraine Nataliya Mikolskaya said, these consultations have not given the expected result, in connection with which Kiev said about the intention to seek creation of a panel of WTO arbitrators on this issue. Then on February 9, 2017 Ukraine has sent the WTO a request to form a panel of arbitrators on the issue of restrictions of transit through Russia to third countries.
