The court has introduced bankruptcy proceedings at the Kursk factory of «Milkiland»

The arbitration court of Kursk region declared bankrupt LLC "Kursk-Moloko" (owned by LLC "Milkiland Ru", the Russian structure of the Ukrainian group "Milkiland") and started bankruptcy proceedings against the company, follows from the file of arbitration cases.

The corresponding decision was made by the court on March 3. According to the materials, the application for the introduction of bankruptcy proceedings at the enterprise was received from its creditors. In addition, on February 27, the arbitration court issued a decision on the introduction of interim measures on the application of the interim manager.

"To take additional interim measures in the form of a ban on making transactions without the consent of the interim manager for the alienation of the property of LLC “Kursk-Moloko” with contractors who are interested parties in relation to LLC “Kursk-Moloko” or LLC “Milkiland Ru” and have overdue debts for previously shipped products", the documents say. 

The interim manager said that on February 26, he became aware of an application from LLC “Ostankino dairy plant” (controlled by LLC “Milkiland Ru”) to ship more than 18 tons of products from “Kursk-Moloko” without prepayment. In his opinion, this "creates a threat of significant amounts of assets being disposed of from the debtor's property in favor of its participant, which will lead to a decrease in the amount of real property in the debtor's bankruptcy estate and, as a result, will harm the property interests of the debtor and its creditors". 

Earlier it was reported that the main creditor of "Kursk- Moloko" is the structure of the group "Neva milk" - LLC "Nevsky cheeses" (Cherepovets), which in February this year became the legal successor of the Bank "Vozrozhdenie" (MOEX: VZRZ) in the bankruptcy case of "Kursk- Moloko". The Bank's claims, as of November last year, amounted to 101.8 million rubles. The reasons for which the Bank transferred the rights of claim to the debtor to the Cherepovets company are not disclosed in court documents.

In October 2019, the Arbitration court of Kursk region, at the request of the bank “Vozrozhdenie”, introduced a monitoring procedure for “Kursk-Moloko”. The reason for the bank's appeal to the court was the debt of “Kursk-Moloko” as a guarantor for the loan of JSC “Ostankino dairy plant” (owned by the holding company of “Milkiland” group - Milkiland N.V., the Netherlands). At the time of the appeal to the court, the amount of claims of the bank “Vozrozhdenie” for “Kursk-Moloko” was 248.2 million rubles. In the process of reviewing the case, the bank reduced its claims to 101.8 million rubles.

The production capacity of “Milkiland” group in Ukraine, Russia and Poland is 1.33 million tons of milk per year. In Ukraine, the group owns 10 factories that produce a large range of dairy products, including cheeses, fresh dairy products and butter. In Russia, “Milkiland” produces dairy products under the brand “Ostankinskaya” on the basis of JSC “Ostankino dairy plant”.
