The Rospotrebnadzor establishes the criteria for the distinguishing characteristics of food
According to the Dairy Union of Russia and the Secretariat TC 470/MTK532, this provision expands the powers of the Rospotrebnadzor, and does not have a legal basis for the mechanism for the Rospotrebnadzor to make decisions about what is correct and what is not written correctly by the manufacturer.
This may be partly the implementation of the Federal law N 280-FZ of 03.08.2018 "On organic products and amendments to certain legislative acts of the Russian Federation", as well as departmental documents of the Rospotrebnadzor (which raises many questions, since these documents are voluntary in nature).
There may be certain barriers in the free circulation of products the labelling of which indicates distinctive characteristics.
The Dairy Union of Russia advises its members, as well as all producers of dairy products, to approach carefully the formation of an evidence base for all information submitted for labeling.
For example, such distinctive features as "bio-product", "natural product", "eco-product", "organic product", "fat-free product", "lactose-free product", "contains a lot of protein", "selected product", "increases immunity", "improves health", etc., must have an evidence base.
